1. The terms and conditions of the tariff provisions relating to

storage shall be applied in a uniform manner without regard to

affiliation of any storage customer to Total Peaking Services, LLC.

2. Total Peaking Services, LLC will strictly enforce tariff provisions for which

there is no discretion in the application of the provision.

3. Total Peaking Services, LLC will not give its marketing affiliates preference

over non-affiliated storage customers in matters relating to Part 284

transportation in scheduling, balancing, transportation, storage or curtailment priority.

4. Total Peaking Services, LLC will process all similar requests for storage and transportation

service in the same manner and will take reasonable steps to process

such requests uniformly. Total Peaking Services, LLC maintains non-discriminatory

rules and procedures for answering potential storage customer inquiries.

5. Total Peaking Services, LLC will not disclose to its marketing affiliates any

information that was obtained from non-affiliated storage customers or

potential non-affiliated storage customers unless the prior consent of

the parties to which the information relates has been given, which

consent shall be voluntary and in writing. This will be accomplished by

instructing all persons with access to storage information that this

information is confidential and that sharing this information with

others is prohibited, unless specifically authorized.

6. To the extent Total Peaking Services, LLC provides information related its system or the system

of an affiliated pipeline to its marketing affiliates, Total Peaking Services, LLC

will contemporaneously disclose that information to all

non-affiliated and potential non-affiliated shippers on its system.

7. Total Peaking Services, LLC has separated its operating personnel and the

operating personnel of its marketing affiliates so as to function

independently of each other. Other than a mainframe computer system and

telephone equipment, Total Peaking Services, LLC does not share facilities with its

marketing affiliates. The mainframe computer equipment, including access

to all computer databases, is password protected in order to maintain

segregation of utilization and confidential access to tile system.

8. (a) If Total Peaking Services, LLC offers a Storage discount to its marketing

affiliates or offers a discount for a Storage transaction in which its

affiliated marketer is involved, Total Peaking Services, LLC will make a comparable

discount contemporaneously available to all similarly situated,

non-affiliated storage customers, (b) Within twenty-four hours of the

time that storage service commences under the storage transaction in

which its affiliated marketer receives a discounted rate OF under the

storage transaction at a discounted rate in which its affiliated

marketer is involved, Total Peaking Services, LLC will post a notice on its telephone

bulletin board. Such posting shall remain on the telephone bulletin

board for a period of thirty days from the date of posting and will

include the name of the marketing affiliates involved in the discounted

storage transaction, the rate charged, the maximum rate, the time period

for which the discount applies, the quantity of liquefied natural gas

scheduled to be stored, conditions or requirements applicable to the

discount, and the procedures by which a non-affiliated storage customer

can request a comparable offer.

9. Total Peaking Services, LLC maintains its books of account and records (as

prescribed under Part 201) separately from those of its marketing

affiliates.

10. Total Peaking Services, LLC will maintain a written log of waivers that

Total Peaking Services, LLC grants with respect to tariff provisions that provide for

such discretionary waivers and will provide the log to any person

requesting it within twenty-four hours of the request.

11. Total Peaking Services, LLC will post the names and addresses of its marketing

affiliates on its internet web site and update the information within

three business days of any change. Total Peaking Services, LLC will also state the

date the information was last updated. These postings conform with the

requirements of IS CFR Part 284. 10.
